Terms of Service

These Terms of Service ("Terms") govern your use of CallCast, a voice broadcast platform operated by SoftwarePlus Tech Inc. ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.

1. Service Description

CallCast is a voice broadcast and messaging platform that allows you to send automated voice calls and SMS messages to contact lists using text-to-speech, pre-recorded audio, and interactive IVR flows. The Service is available at callcast.softwareplus.app.

2. Account Registration

  • You must be at least 18 years old to use the Service.
  • You must provide accurate and complete registration information.
  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • One person or entity may create one organization. Team members may be invited by the organization owner on eligible plans.

3. Acceptable Use

You agree to use CallCast only for lawful purposes. You must NOT:

  • Send calls or messages to individuals who have not consented to receive them
  • Violate the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, or any applicable telecommunications laws
  • Send threatening, harassing, fraudulent, or deceptive messages
  • Use the Service for robocalling or illegal telemarketing
  • Upload contact lists obtained without proper consent or from purchased/scraped sources
  • Attempt to circumvent opt-out mechanisms or DNC (Do Not Call) lists
  • Impersonate another person or entity in your calls or messages
  • Interfere with or disrupt the Service or its infrastructure

4. Messaging Compliance

When using SMS/MMS features, you are responsible for ensuring compliance with all applicable messaging regulations, including:

  • Obtaining proper consent from recipients before sending messages
  • Honoring opt-out requests (STOP keyword) promptly and completely
  • Including required disclosures in opt-in flows (message frequency, data rates, opt-out instructions)
  • Maintaining records of consent for each recipient

5. Subscription Plans and Billing

  • CallCast offers monthly subscription plans (Starter, Pro, Business, Enterprise) with different credit allocations, contact limits, and features.
  • Subscriptions are billed monthly in advance through Stripe.
  • Voice credits are consumed per call attempt. Unused credits do not roll over to the next billing period.
  • Additional credit packs may be purchased at any time.
  • Team seats beyond those included in your plan are billed at $5 per seat per month.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • We reserve the right to change pricing with 30 days' notice.

6. Your Content and Data

  • You retain ownership of all content you upload (contact lists, audio recordings, campaign configurations).
  • You grant us a limited license to use your content solely to provide the Service.
  • You are solely responsible for the accuracy and legality of the contact data you upload and the messages you send.
  • We may delete your data in accordance with our Privacy Policy or upon account termination.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service depends on third-party providers (Telnyx for telephony, Stripe for billing) whose availability is outside our control. We are not liable for losses caused by service interruptions.

8. Termination

  • You may close your account at any time by contacting us.
  • We may suspend or terminate your account immediately if you violate these Terms, engage in abusive calling practices, or fail to pay for services.
  • Upon termination, your access to the Service will cease and your data may be deleted after a reasonable retention period.

9. Limitation of Liability

To the maximum extent permitted by law, CallCast and SoftwarePlus Tech Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service, including but not limited to lost profits, lost data, or business interruption.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless CallCast, SoftwarePlus Tech Inc., and their officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party rights.

11. Modifications

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page. Continued use of the Service after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
